Scope

This policy concerns personal information handled by HarbourView Legal Pty Ltd in website enquiries and the provision of legal services. Privacy Act 1988 (Cth) obligations apply where the firm or the relevant activity is covered by that Act. Separate professional duties of confidentiality may also apply.

Information and sources

Depending on the enquiry or matter, information may include a name, contact details, organisation, role, preferred language, service of interest, correspondence and documents relevant to the instructions. Information may come directly from the individual, an authorised representative, public registers or other parties involved in the matter.

Identity, ownership, authority to act and transaction information may also be needed where legal requirements apply. Sensitive information should be limited to what is necessary and collected with consent or another lawful basis. Please begin with a short, non-confidential description.

Purpose and disclosure

Information may be needed to answer an enquiry, check conflicts, assess whether the firm can act, provide agreed legal services, administer the engagement or meet legal obligations. Relevant recipients may include people assisting with the matter, barristers or other advisers, courts, counterparties, service providers and regulators, as permitted or required by law and applicable duties of confidentiality.

If required information is unavailable, the firm may be unable to respond fully or proceed with a service. Browsing the public pages does not require a name. An anonymous enquiry may limit the assistance available.

Website enquiries and technology

The enquiry function on this website prepares an email on the device. The message is sent only when it is sent through the email application; preparing it does not submit it to a website inbox or confirm a booking. The email provider’s own handling of the message also applies.

This website includes no analytics tracker, advertising tracker or embedded live chat. Hosting and network services may create technical access records such as IP addresses and request times. Features introduced later will require a corresponding review of this policy.

Storage, security and overseas handling

Electronic communications carry security risks. Please arrange an appropriate transfer method with the firm before providing identity documents or sensitive material.

Applicable privacy obligations require reasonable protection of personal information. Retention depends on the matter, legal and professional record requirements and other permitted purposes. Those requirements can limit requests for deletion.

This policy does not represent any particular storage location or overseas recipient. Where this matters for a particular matter, please ask the firm before providing the information.

AML/CTF information

Where the firm handles personal information for obligations under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth), privacy obligations apply to that handling, including where a small-business exemption may otherwise apply. The scope and handling of the information depend on the relevant service and legal requirements.

Access, correction and complaints

An individual may request access to, or correction of, their personal information and raise concerns using the contact options below. Identity and authority may need to be verified. Access and explanations can be limited by law, confidentiality or privilege.

For a privacy complaint, describe what happened and the outcome sought. Where the Privacy Act applies, an unresolved complaint may be taken to the Office of the Australian Information Commissioner, subject to its process and jurisdiction.
